1. Acknowledgement and acceptance of terms and conditions

By using the WGNZ website, you (the user) accept the terms and conditions on this site.
WGNZ retains the right to change or amend any of the terms and conditions on this site without prior notice.
Changes listed on the site will be effective immediately. WGNZ will not be held accountable for losses incurred
by users as a result of these changes.
2. Age limitations
Users must be aged 18 years or older to use the WGNZ website for purchasing any alcohol related product.
By submitting an order to WGNZ for an alcohol related product you confirm you are 18. You will be required to
verify your date of birth to WGNZ. No responsibility will be taken by WGNZ if you illegally submit an order.
3. Liquor licensing compliance
WGNZ does hold a liquor licence. All sales of wine advertised on this site are performed by licensed
independent wineries or liquor merchants who do not sell or deliver wine to people under the age of 18.
You fully indemnify WGNZ and WGNZ suppliers against any breach of the above age requirement that
results in legal action being taken against WGNZ or its suppliers.
4. Order processing
Each order submitted to WGNZ is an offer by the user , to purchase wine as listed on the site and specified in the order.
The order will be processed by WGNZ, which will either accept the order (by consigning the wine to the delivery address and
processing your payment instructions) or contact you if there is any reason why it cannot accept the order (such as incomplete
payment arrangements, inadequate delivery details or insufficient evidence of age).
For your security we provide the use of a secure server to protect the information you supply to us,
ie credit card numbers and contact information. This information cannot be used by anybody except WGNZ.
5. Supply limitations
Wines and wine offers listed on the WGNZ website are subject to stock availability, and will often be available
at the listed price for a limited time only.
WGNZ cannot guarantee how long a product will be listed before it sells out, subject to supply and demand.
WGNZ will do everything possible to ensure products which have sold out are de-listed as quickly as possible to avoid customer
disappointment. WGNZ is not liable for being unable to fill orders of wine advertised on the site.
6. New Zealand & International deliveries
WGNZ is owned and operated from within New Zealand.
WGNZ cannot make any warranty that information and products on the site are appropriate for use in
other countries or that the site or the products meet the laws of other countries.
If you access the WGNZ site from another country, you do so at your own risk and are responsible for
ensuring that accessing the site is not illegal under local laws.
By law WGNZ is required to attach customs documentation to all outbound international packages including a description
of the goods and stating their $ value. Customs or import duties may be levied once the package reaches your country.
These additional charges for customs clearance must be borne in full by the customer.
WGNZ have no control over these charges and cannot predict what they may be. Customs policies vary widely from
country to country. You may want to contact your local customs office for further information on such matters.
7. Pricing system
Prices on the WGNZ site are stated in NZ dollars (NZD) and include GST, unless otherwise stated.
Users agree to not attempt to buy a product viewed on the WGNZ site directly from a supplier independently of the WGNZ site.
8. Buyer obligations
Users must provide a delivery address with adequate delivery instructions, when placing an order on the WGNZ site.
In particular, users listing a delivery address that is not their own (either home or work) must take every reasonable step to
ensure that the wines arrive safely, including drop off instructions and contact person with telephone details if required.
WGNZ take no responsibility for deliveries to an address other that of the person ordering.
9. Returns / Faulty Delivery
Wines listed on WGNZ come with a 100% guarantee. If you are not satisfied with your wine purchase from us,
please inform us immediately by email or phone and we will make arrangements with a more suitable wine for you.
Similarly if a wine purchased from us is “corked” or in some way faulty we will replace it upon your request.
This applies only to orders within New Zealand and excludes all international orders.
Buyers from the WGNZ website guarantee not to abuse the WGNZ returns policy for personal gain.
10. Privacy
WGNZ collects and stores the information of visitors who sign up, to advise users of new offers, analyse customer demand,
improve WGNZ product listings and improve customer satisfaction with the site.
Information collected by WGNZ for these purposes will be retained on our database.
You have the right under the Privacy Act 1993 to access any personal information held about you and correct or delete any
wrong information from the WGNZ database. You can do this by sending an email request to the WGNZ website.
11. Links to other websites
Links to other websites from the WGNZ site do not imply any endorsement or recommendation of those sites and no responsibility
can be taken by WGNZ for the accuracy or appropriateness of information at those sites or any damage or harm resulting from
those links being included on the WGNZ site.
12. Copyright and Trademarks, etc
All intellectual property rights to material on the WGNZ site are owned by or licensed to WGNZ. Except as authorised by these terms
and conditions, you may not copy, adapt, store, distribute or reproduce any part of this site without the written permission of WGNZ.
Copyright and other intellectual property rights exist in the WGNZ name and trademark, in suppliers’ trademarks and in other
material which are produced on the site. Unauthorized use of that material is unlawful and may give rise to claims of
intellectual property right infringement and rights to injunctive relief and damages.
13. User conduct
Users of the WGNZ website agree not to interfere with any systems, software or networks connected to WGNZ.
14. Limited liability
All caution is taken in ensuring information on the WGNZ website is correct when submitted and presented in good faith.
We offer no warranty of accuracy or detail of information. This extends to sites linked to WGNZ.
Users use the WGNZ website at their own risk. WGNZ takes no responsibility for any users’ loss or damage, financial or otherwise,
through using the site, from any product purchased via the website or linked sites, or use of information on this website.
In particular, WGNZ will not be responsible for direct, indirect, special or consequential damage, including loss of profits,
loss of bargain or loss of data, whether claimed in contract, tort (including negligence) or on other grounds.
This does not exclude remedies available to consumers by virtue of the Consumer Guarantees Act or other
binding statutory provisions, to the extent that they cannot be excluded by agreement.
WGNZ takes no responsibility for viruses or any other interference that may disrupt or damage users’ computer
systems as a result of using the WGNZ website. This extends to sites linked to WGNZ.
Information sent to us through a secure system and all reasonable steps have been made to ensure it remains
secure, but we cannot warrant all information will be secure at all times.
15. Jurisdiction
This agreement is governed by the laws of New Zealand and is subject to the jurisdiction of the New Zealand Courts and
any disputes arising from it will be contested in a New Zealand court only in, the town of WGNZ company registration.
